Terms of use

These Terms of Use are an integral part of the purchase of products, which the parties, based on the customer’s order, conclude at our online point of sale www.icegarden.lv The obligations included in the Terms of Use are mandatory.

By placing an order, the customer confirms that he has read, understood and agrees to the Terms of Use. The customer is not allowed to order goods from our online sales site www.icegarden.lv if the customer has not read and agreed to the Terms of Use.

1.Terms

  • Icegarden – online trading site www.icegarden.lv and the owner of the related rights SIA “Icegarden”, registration No. 40103975196, legal address: “Melluži”, Sējas novads, LV-2142, which offers and sells goods to the customer during its economic activity in accordance with these terms of use;
  • Customer – a natural person who orders goods from Icegarden, who has reached the age of 18 and who has unlimited legal capacity to enter into a contractual relationship with Icegarden;
  • www.icegarden.lv – online sales site www.icegarden.lv which the customer uses to place an order;
  • Delivery – the goods ordered by the customer are delivered to Omniva parcel terminals.

2.Coupon Terms of Use

If the Buyer has a discount coupon with a code, then the Buyer can add a discount coupon code to the purchase by entering it in the special input field under the name “Coupon code”. Once the code has been entered, the “Apply coupon” button must be pressed. The system will automatically recalculate the price with the added discount. In some cases, discount coupon codes may also be published on social networking sites or other public space in order to promote sales.

The discount coupon is sent to the buyer by e-mail or handed over in another format, according to the contacts indicated by him and / or the current promotions organized by SIA ICEGARDEN. Discount coupons are most often sent to the most active buyers.

3.Price, payments and delivery costs

Product prices at www.icegarden.lv are indicated in EUR. All prices are quoted, including any value added tax or other tax. The goods are sold at the prices valid at the time of order creation. Total Delivery Price may include fees. The bank fee may be applied depending on the bank used by the customer.

After receiving the order, Icegarden sends the customer an e-mail justification document – an electronically prepared invoice. Electronically prepared justification document – the invoice is valid without a signature.

*Goods are assembled in boxes and plastic bags, frozen goods can be assembled in light plastic bags.

Right of withdrawal

The customer has the right to unilaterally exercise the right of withdrawal within 14 days of receipt of the order, immediately informing Icegarden about their use. The right of withdrawal may be exercised as provided in the laws and regulations, these Terms of Use and other applicable terms and conditions issued by Icegarden. The customer is responsible for the costs associated with the return of such orders.

If the Customer has thought about perishable products, they can be returned within the expiration date.

The customer has the right to refuse the ordered product within 14 days by notifying Icegarden Customer Service.

When returning groceries to the store, they must be in the original packaging, unopened, within the expiration date +1 day. If the customer is unable to meet these requirements, Icegarden reserves the right not to pay the customer for the returned goods.

If the Customer has found after receiving the order that the product is damaged and / or of poor quality, the Customer applies to Icegarden Customer Service with an application, which is accompanied by a photo of the damaged product and Customer Service will arrange a refund to the Customer’s account. Icegarden reserves the right to ask the Customer to return all damaged goods via Omniva, from which the delivery or delivery was made.

WHAT TO DO IF THE SHIPMENT HAS NOT REACHED ITS DESTINATION?

If the shipment sent to you has been lost, submit an application with a request to search for the shipment. The application can be submitted to www.omniva.lv in the e-self-service environment or by sending it to e-mail info@omniva.lv

Attach a receipt / check / bank statement for sending the shipment to the written application.

WHAT TO DO IF YOU RECEIVE THAT THE GOODS ARE DAMAGED AFTER RECEIPT THE SHIPMENT?

Notify us of the defective product at the earliest opportunity. If the shipment is delayed, damaged or lost, you can file a claim with us within five days. Claims are accepted until the end of the 30-day period from the moment the shipment is sent.

If you would like to submit a complaint to us, please contact our customer service department. A separate application must be submitted for each damaged shipment.

Final provisions and dispute settlement

If Icegarden violates these Terms of Use, Icegarden will only be liable for damages suffered by the Customer as a direct result of the breach, insofar as such damages are reasonably foreseeable by both parties.

Icegarden may unilaterally make changes to these Terms of Use. If Icegarden makes changes to the Terms of Use, Icegarden will inform the Customer without undue delay by posting information about the changes at www.icegarden.lv or sending this information by SMS or e-mail.

These Terms of Use have been prepared in accordance with and regulated by the laws and regulations of the Republic of Latvia and all disputes are subject to the courts of the Republic of Latvia.

If any of the conditions contained in the Terms of Use are, in the opinion of a court or other competent authority, deemed to be unlawful, incorrect or inapplicable, it will affect the validity of the other Terms of Use, which are valid and enforceable in full.

If the Customer considers that Icegarden has violated these Terms of Use or other applicable laws and regulations and this has affected the Customer’s ability to exercise his rights and it is not possible to resolve such a situation in mutual negotiations, the Customer may apply to the national consumer protection authority.

Data processing and protection

The Customer’s personal data will be used to identify the Customer and receive the order, place the order and delivery, prepare accounting documents, including the invoice, return the amount for returned products, administer financial obligations and other obligations arising from these Terms of Use and distance contract, as also for the use of the services offered by www.icegarden.lv.
